United States Seventh Circuit
Wrightsell v. Cook County, 09-2634
In a former inmate's 42 U.S.C. section 1983 suit against a county claiming that the failure to make more than a single dentist available to the jail's 10,000 inmates was cruel and unusual punishment in violation of the Eight Amendment, defendant's appeal from the district court's denial of class certification is dismissed and another former inmate's petition to intervene is denied where the plaintiff has no personal stake in having the class certified as he has settled his claim and has gotten all the relief that he sought, and the other plaintiff failed to ask the district court for permission to intervene in the case within the statutory deadline for filing a notice of appeal.
