United States Seventh Circuit

Luster v. Allstate Ins. Co., 09-2483

In plaintiff's action for breach of an insurance contract against his deceased client's insurer, arising from the insurance company's denial of claims for extensive fire damage to the client's house, summary judgment in favor of the defendant is reversed and remanded as the plaintiff is entitled to a hearing on whether an exclusion applies as the district court's decision was based not on cancellation but on the hazard exclusion.
