GCIU-Employer Retirement Fund v. The Goldfarb Corp., 08-3229

In an action seeking to collect withdrawal liability payments under ERISA, district court's grant of defendant's motion to dismiss for lack of personal jurisdiction is affirmed where: 1) plaintiff did not meet its burden to prove that its cause of action was one arising out of defendant's minimum contacts with the U.S.; and 2) the court did not abuse its discretion in denying plaintiff's request for further discovery and finding that further information was unlikely to yield evidence of any contacts arising out of the withdrawal from the employee retirement fund.
