Cole v. State of Illinois, 08-1754
In a retaliation action brought under the Family Medical Leave Act, district court's grant of summary judgment for defendants is affirmed where: 1) plaintiff did not introduce any evidence to suggest that her termination stemmed from any cause other than her refusal to sign the performance improvement plan; and 2) the adoption of the performance improvement plan did not constitute an adverse action that would have dissuaded a reasonable employee from exercising her rights under the FMLA.
