Lewis v. CITGO Petroleum Corp., 08-1483

In a negligence action, district court's grant of summary judgment in favor of defendant is affirmed where: 1) the court did not abuse its discretion in excluding expert testimony and thus plaintiffs cannot establish the requisite causation for their claims; and 2) plaintiffs could not establish causation for the negligent infliction of emotional distress claim, as the emotional injury to plaintiff was not severe enough to be compensable.
