United States Seventh Circuit
Simpson v. Office of the Chief Judge of the Circuit Court of Will County, 08-1523
In an adverse employment action brought under the Family Medical Leave Act, district court's grant of defendant's motion for summary judgment is affirmed where: 1) plaintiff's claim of interference with her FMLA rights fails as she did not provide any evidence that she would still be employed had she not taken leave and that she was entitled to reinstatement following her leave; and 2) plaintiff's claim of FMLA discrimination fails as she did not present evidence that defendant discriminated against her for taking leave.
