In an adverse employment action, district court's grant of defendant's motion for summary judgment is vacated where the proper disposition of the case requires a remand with instructions to dismiss without prejudice, as plaintiff failed to exhaust her administrative remedies prior to bringing suit under the Rehabilitation Act.
