United States Seventh Circuit

Leibowitz v. Great Am. Group, 07-3693

In a bankruptcy action, district court judgment is reversed and remanded where co-defendant LaSalle Bank's contract to indemnify defendant was enforceable despite defendant's failure to disclose information to co-defendant, as LaSalle Bank would not have acted any differently had it known the information and had not shown any loss from the failure to disclose.
