United States Seventh Circuit

Capitol Indemnity Corp. v. Elston Self-Serv. Wholesale Groceries, Inc., 08-1888

In a dispute over an insurance coverage claim, district court's grant of defendant's motion for summary judgment is affirmed where the advertising injury clause in plaintiff's insurance policy requires it to defend defendant in the underlying lawsuit as the prior publication exclusion in the policy does not apply.
