United States Seventh Circuit
Leger v. Tribune Co. Long Term Disability Benefit Plan, 08-1362
In an ERISA action for payment of benefits due, district court's grant of defendant's motion for summary judgment is reversed and remanded for further findings and explanation where defendant acted in an arbitrary and capricious manner in terminating plaintiff's benefits as it failed to consider plaintiff's complete medical history and rejected important aspects of the Functional Capacity Evaluation without providing adequate reasoning.
