Lindquist Ford, Inc. v. Middleton Motors, Inc., 08-1067
In a breach of contract action between auto dealerships, judgment for plaintiff under quantum meruit and unjust enrichment is reversed where: 1) the district court misconstrued the liability principles of quantum meruit under Wisconsin law and consequently mistried the claim; 2) the district court erroneously excluded relevant evidence to the unjust enrichment claim; and 3) failed to weigh the particular equities at stake in the commercial circumstances of this case.
