Kurz v. Fidelity Mgmt. and Research Co., 08-2733
In a breach of contract action involving securities, district court's denial of motion to remand and judgment in favor of defendant is affirmed where: 1) the plaintiff's claim about the misconduct of defendant's employees in regards to securities trades was a securities law issue and the proceeding belonged in federal court under the Securities Litigation Uniform Standards Act; and 2) plaintiff filed suit after the federal statute of limitations had run and was unable to show injury.
