Ogbolumani v. Napolitano, 08-2143

In an appeal of a denial of a visa petition, the District Court's grant of the U.S. Citizenship and Immigration Services motion for summary judgment is affirmed where: 1) the denial of the visa petition did not violate the Administrative Procedure Act as it was supported by substantial evidence and a reasonable mind could therefore find adequate support for it; and 2) the denial was not arbitrary and capricious and did not violate their rights under the Due Process Clause as there were no egregious administrative irregularities.
