United States Seventh Circuit
US v. England, 082440
Sentence of 210 months' imprisonment for illegal possession of a firearm is vacated where there was an insufficient quantum of evidence to support the court's assumption that defendant, if out on bond, would have possessed the criminal intent to kill and performed an act constituting a substantial step toward the commission of murder, as required to prove the crime of attempted murder in the state.
