In a securities claim in which plaintiffs brought suit on their own behalf and for a class of plan participants alleging defendant violated its fiduciary duty under Employee Retirement Income Security Act (ERISA) by providing investment options that required the payment of excessive fees and costs and by failing to adequately disclose the fee structure to plan participants, grant of motion to dismiss without resolving the class certification motion, is affirmed where the district court correctly found that plaintiffs failed to state a claim against any of the defendants.
