United States Seventh Circuit

Giles v. Wyeth, Inc., 073149

In a wrongful death action against defendant-drug manufacturer of antidepressant Effexor forty-six year old decedent began taking two days before his death, judgment in favor of defendant-manufacturer is affirmed where: 1) the later warning focused on the risk of suicide in younger persons, not adults of decedent's age; 2) there was no evidence that defendant knew or should have known the information contained in the later warnings at the time of decedent's death; and 3) district court did not abuse its discretion when it excluded later warnings.
