First State Bank of Monticello v. Ohio Cas. Ins. Co., 06-3685, 06-3794

In a suit arising out of the denial of coverage under a bond for losses suffered by a bank through fraud, summary judgment for plaintiff-bank is affirmed where: 1) the fraudulent scheme was a covered risk under the bond's terms; 2) an exclusion for losses caused by an employee did not apply; and 3) plaintiff's tardy application for statutory prejudgment interest was brought too late to entitle it to an award.
