Kelley v. Med-1 Solutions, LLC, 08-1392
In an action involving the Fair Debt Collection Practices Act (FDCPA), dismissal for lack of subject matter jurisdiction based on the Rooker-Feldman doctrine is affirmed where: 1) the FDCPA claims ultimately requires the court to evaluate and determine that the state court judgments granting the attorney fees were in error; and 2) the plaintiffs had opportunities to raise their FDCPA claims in state court upon transfer of their cases to the plenary docket.
