United States Seventh Circuit

Maher v. City of Chicago, 07-2911

In a suit alleging that defendant-employer wrongfully demoted plaintiff on three occasions for being absent from work while on active duty in the Naval Reserves, summary judgment for defendants as to two of the claims, and jury verdict for defendant on the third, are affirmed where: 1) plaintiff waived his appeal as to the first claim by not addressing both of the alternative bases for the holding; 2) evidence of the alleged demotions was properly excluded at trial; and 3) there was sufficient evidence to support the jury's verdict.
