Trigillo v. Snyder, 06-2578
In a suit alleging termination in retaliation for plaintiff's statements regarding purported misconduct by the state agency which employed her, summary judgment for defendants is affirmed where: 1) a report prepared by plaintiff outlining her concerns was prepared within the scope of her employment, and was not protected by the First Amendment; and 2) plaintiff's supervisor was not aware that plaintiff had made a report to the FBI, and this report could therefore not have been the basis for her termination.
