United States Seventh Circuit
Interactive Intelligence, Inc. v. KeyCorp, 07-4058
In a suit alleging various contractual and tort claims arising out of foreign exchange currency transactions, summary judgment for defendants is affirmed where: 1) plaintiff was not a third-party beneficiary of an employment contract between defendant-bank and defendant-bank employee; 2) defendant-employee did not breach any duty of care to plaintiff, and defendant-bank therefore did not breach its duty to supervise; and 3) an alleged oral contract regarding fees for the currency transactions was too vague to be enforceable.
