Chaudhry v. Nucor Steel-Indiana, 07-3729
In a Title VII suit alleging that defendant-employer unlawfully denied plaintiff a raise, and refused to allow him to qualify for increased compensation by visiting customers, dismissal for failure to state a claim is affirmed in part and reversed in part where: 1) plaintiff's claims arising from a single past decision not to give him a raise were time-barred; but 2) defendant's alleged failure to inform plaintiff about customer-visit opportunities would constitute a fresh violation every year when plaintiff was denied raises on this basis, and so the claim on this issue was not time-barred.
