Foster v. DeLuca, 05-1491
In a suit alleging that plaintiff was terminated in retaliation for her political affiliation, dismissal for failure to state a claim is reversed where, although the right to amend is not absolute, the district court abused its discretion by denying plaintiff's motion to amend without explanation.
