United States Seventh Circuit

Am. Nat'l Ins. Co. v. Citibank, N.A., 07-3746

In a suit arising from an employee's embezzlement via altering and depositing checks in an account with defendant bank, summary judgment for defendant on claims of conversion is affirmed where plaintiff, as a party contracting with the employer, lacked any property interest in checks made out to the employer, even though the checks represented funds that would ultimately be owed to plaintiff.
