In a contract suit seeking additional royalties for coal mined from plaintiff's property, judgment as a matter of law for defendants is affirmed where: 1) denial of plaintiff's motion for continuance to evaluate new discovery evidence was proper; 2) testimony of plaintiff's expert witness was properly excluded as not meeting the standards of Fed. R. Evid. 702; and 3) there was no reasonable basis in the evidence for the jury's damage award.
