Bakarian v. Mukasey, 06-3228
In an immigration case in which the government sought removal of petitioner as having been convicted of crimes of moral turpitude, petition for review of denial of cancellation of removal and waiver of inadmissibility is denied where: 1) petitioner did not meet the continuous-residence standard for eligibility of a cancellation of removal; and 2) petitioner's failure to raise the application of the stop-time rule before the BIA was not excused by futility, and the court therefore lacked jurisdiction to hear the issue on appeal.
