In an action alleging that petitioner-truck driver was retaliated against by his employer for refusing to violate federal hour restrictions, petition for review of the Administrative Review Board's decision granting respondent-employer's motion for summary judgment is denied where petitioner failed to rebut employer's articulated, reasonable, non-retaliatory basis for its decision to transfer petitioner from one position to another.
