St. Paul Mercury Ins. Co. v. Viking Corp., 07-1948
In a suit alleging breach of warranty over a defective sprinkler manufactured by defendant that damaged a building owned by plaintiff's insured, summary judgment for defendant is affirmed where: 1) there was no agreement between the insured and defendant when the sprinkler was purchased, and privity of contract therefore did not exist; and 2) state contract law still required privity for breach-of-warranty claims.
