In an inmate's 42 U.S.C. section 1983 suit alleging improper medical treatment by corrections officials during interstate transport of plaintiff, dismissal of some defendants for lack of personal jurisdiction is affirmed where: 1) plaintiff waived his arguments for personal jurisdiction based on agency theory; 2) section 1983 does not create vicarious or respondeat superior liability; and 3) plaintiff failed to argue that personal jurisdiction existed over each individual defendant, instead arguing for blanket jurisdiction under his agency theory.
