Freedom From Religion Foundation, Inc. v. Nicholson, 07-1292

In a 42 U.S.C. section 1983 suit alleging violation of the Establishment Clause by employees of the Department of Veterans Affairs, summary judgment for defendants is vacated and the case remanded with instructions to dismiss for lack of jurisdiction where plaintiffs lacked standing as taxpayers to allege Establishment Clause violations.
