Fabriko Acquisition Corp. v. Prokos, 06-3889

In a contract suit arising from the failed purchase of a piece of property, summary judgment for defendants and Rule 11 sanctions imposed upon plaintiff's counsel are affirmed where: 1) plaintiff failed to produce evidence demonstrating that defendants-purchasers did not make a good-faith effort to obtain financing as required by the contract; and 2) plaintiff's counsel failed to investigate whether it should withdraw or correct its claim against defendant-attorney even after being put on notice that the claim had no legal basis under the facts of the case.
