McCarty v. Astrue, 07-2104
In an action to receive disability insurance benefits and supplemental security income, an appeal from a decision affirming a denial of benefits is dismissed for lack of jurisdiction where the notice of appeal was untimely, and the district court abused its discretion in granting plaintiff's motion for an extension of time to file a notice of appeal since as mistake by counsel was inexcusable.
