Michalowicz v. Vill. of Bedford Park, 06-3857
In an action alleging due process violations after plaintiff was terminated for accepting donations from local businesses subject to fire inspection and allegedly failing to adequately inspect their properties, dismissal of plaintiff's complaint is affirmed where: 1) plaintiff did not state a due-process claim arising out of his post-termination hearing since the Illinois Administrative Review Act provides adequate remedies for the alleged violations; and 2) Illinois law is an adequate remedy for pre-termination violations since plaintiff admitted that state law provided him with the constitutional protections he alleged were denied.
