Callahan v. Fermon, 05-4313, 05-4335, 06-1055, 06-1098

In an action claiming retaliatory action by plaintiff's superiors arising out of comments made about a cold case and official complaints about his superior officers, judgment for plaintiff is reversed and the case remanded with instructions to enter judgment for defendants where plaintiff was speaking pursuant to his official duties, not as a citizen, and therefore was not entitled to protection by the First Amendment.
