Gao v. Mukasey, 06-4431

Petition for review of the BIA's denial of a motion to reopen asylum proceedings is denied where the petitioner was not entitled to equitable tolling of the 90-day period in which to file a motion to reopen since he did not show that a diligent attempt to comply with the deadline would have failed.
