United States Seventh Circuit
United Rentals Highway Techs., Inc.v. Indiana Constructors, Inc., 06-4367
In a suit alleging that a contractors' association and a union conspired to exclude a provider of construction services from the traffic control market in Indiana, summary judgment for defendants is affirmed where: 1) the ban on contracting with non-union subcontractors contained in defendants' collective bargaining agreement did not violate the Taft-Hartley Act since it fell under the exception for work conducted on construction sites; and 2) the ban did not implicate any traditional antitrust concerns.
