Foskett v. Great Wolf Resorts, Inc., 07-2209
In a suit concerning the indemnification of sellers of property against post-sale personal injury claims, summary judgment for the buyers of the property is reversed where the language of the purchase agreement showed that the parties intended to allocate the risk of tort liability based on who had control over the property when the claim arose, and the underlying personal injury claim occurred after the close of the transaction.
