Correa v. White, 07-3785
In a suit against the Illinois Department of Corrections alleging sexual and racial discrimination, harassment and retaliation, defendants-appellees' motion to strike plaintiff-appellant's brief and dismiss her appeal is granted in part and denied in part where, although plaintiff's brief did not meet the requirements of the Federal Rules of Appellate Procedure, dismissal of the appeal is too harsh a sanction since plaintiff is a pro se litigant, the appeal is only two months old and the noncompliance was not unduly prejudicial to defendants. Plaintiff-appellant is ordered to file another brief that complies the federal and circuit rules.
