Prostyakov v. Masco Corp., 06-3928
Confirmation of an arbitral award in an employment dispute involving a US company doing business in Russia is affirmed over the company's claims that the arbitrator exceeded his authority since: 1) the arbitrator lacked the proper authority to serve because an agreement between the parties precluded the involvement of AAA-affiliated arbitrators; 2) an element of the dispute was not arbitrable because it fell outside the scope of the agreement; and 3) the arbitrator fashioned improper monetary and equitable awards. The employee's motion for sanctions is denied where the company had already agreed by contract to reimburse him for attorney's fees and costs.
