Denial of a 28 U.S.C. section 2255 petition alleging ineffective assistance of counsel is affirmed where any error defendant's appellate attorney made in failing to raise a Confrontation Clause issue had no effect on the outcome of his appeal. Defendant's sentence is vacated, however, where his attorney should have attacked the sufficiency of the information underlying the district court's decision to enhance defendant's guideline range by two levels.
