Lake Shore Asset Mgmt. Ltd. v, Commodity Futures Trading Comm'n, 07-3057

In a suit by the Commodity Futures Trading Commission to force a commodity-pool operator and adviser in the derivatives business to turn over records required by statute, an injunction freezing the operator's assets and appointing a receiver is affirmed in part where, even though most of the group's business is with investors from other nations, the group registered with domestic agencies and must abide by federal law, including record-keeping and reporting requirements. The injunction is vacated where it imposes duties on other entities. An appeal of the CFTC's denial of interlocutory relief to the group during administrative proceedings is dismissed for lack of jurisdiction.
