JCW Invs., Inc. v. Novelty, Inc., 05-2498

In a copyright and trademark infringement suit over a novelty farting plush doll, the court awards plaintiff attorney's fees where: 1) plaintiff was diligent in preparing and submitting its request for appellate attorneys' fees; and 2) plaintiff was entitled to an award of the fees that it reasonably incurred in defending against defendant's appeal. The fee award is reduced where the amount of time billed was excessive, however, and a petition for costs is denied where the petition was untimely.
