United States Seventh Circuit

Kannapien v. Quaker Oats Co., 06-2543

In an ERISA suit brought by plaintiffs-former employees who accepted a severance package from defendant-Quaker Oats Company and retired, summary judgment for defendants is affirmed where: 1) there was no issue of material fact on an ERISA estoppel claim and the district court properly held that Quaker and Pepsico were entitled to summary judgment as a matter of law; 2) ERISA claims for breach of fiduciary duty failed as plaintiff failed to show that certain individuals were plan fiduciaries, and did not sue the plan administrators or other fiduciaries; and 3) state-law claims were preempted.
