Hjortness v. Neenah Joint Sch. Dist., 06-3044

In a due process claim by a student and his parents against a school district alleging the denial of a free appropriate public education in violation of the Individuals with Disabilities and Education Act, summary judgment for defendant is affirmed where: 1) an individualized educational plan created by the school district did not fail to fully identify the student's disabilities and his resulting needs, his present levels of educational performance, and his annual goals and short term objectives; and 2) procedural flaws in the drafting of the IEP did not result in the denial of a free appropriate public education.
