Maher v. Harris Trust & Savings Bank, 06-3565
In a suit to recover shares in a cooperative apartment owned as tenants by the entirety by plaintiff and his wife in order to satisfy a judgment against plaintiff personally, grant of plaintiff's motion for reconsideration is affirmed where Illinois law allows property maintained as a homestead to be held in tenancy by the entirety, and considers the shares to be real property that was excluded from satisfaction of the judgment against plaintiff.
