United Mine Workers v. Brushy Creek Coal Co., 06-2324
In a suit by mine workers and their union under the Taft-Hartley Act and ERISA alleging that a health plan negotiated by the parties guaranteed the workers lifetime health benefits, summary judgment for defendant is affirmed where language in the health plan and a nationwide collective bargaining agreement gave the health plan administrator the right to terminate or modify the plan.
