Pollack v. US Dep't of Defense, 07-1104
In a suit alleging that two property transfers among military branches and private parties violated the Comprehensive Environmental Response, Compensation, and Liability Act because the EPA did not sign off on an Army cleanup plan before the property changed hands, dismissal of the complaint is affirmed where CERCLA section 113(h), 42 U.S.C. section 9613(h), strips courts of jurisdiction over challenges to cleanup efforts while they are underway.
