Stevenson v. Hyre Elec. Co., 06-3501

In a suit alleging that plaintiff's employer had notice that she was suffering from a serious health condition and thus violated the Family and Medical Leave Act when it terminated her employment, summary judgment for defendant is vacated and remanded where issues of material fact existed concerning whether plaintiff's behavior was so bizarre that it amounted to constructive notice of the need for leave and whether plaintiff had a "serious health condition."
