US v. Cote, 06-3575

Conviction for attempted enticement and travel for the purpose of engaging in a sexual act with a minor is affirmed over defendant's arguments that: 1) the enticement statute was facially unconstitutional because it did not contain a scienter requirement; and 2) the court erred in instructing the jury about the intent element of the attempted enticement charge.
