Bannon v. Univ. of Chicago, 06-2955
In a suit against a university alleging denials of promotions, discrimination and retaliation in violation of Title VII, summary judgment for defendant is affirmed as to one plaintiff where: 1) she had no timely failure-to-promote claim; 2) she did not establish that she found her workplace subjectively hostile; 3) her claim for intentional infliction of emotional distress was partially preempted and she was not the victim of extreme and outrageous conduct; and 4) Illinois does not recognize a cause of action for retaliatory constructive discharge. Summary judgment for defendant is affirmed as to the other plaintiff where: 1) she never applied for the disputed promotion; and 2) she did not show that the reason given for her termination was pretextual.
